STUDENT CONDUCT PROCEDURES
University Residences conduct procedures are designed to be educational and ensure compliance with all university policies. The student is given the opportunity to hear the information that led to their conduct charge(s), rebut statements made by witnesses, and present witness statements or any relevant information on the student's own behalf.
The decision made by University Residences staff shall be based solely on information introduced during the conduct meeting and obtained during subsequent investigations.
Responsibility is determined based on the threshold of "preponderance of the information". This means the information used to make the decision need only be more likely than not that a behavior occurred (51% chance) for University Residences to determine a finding of responsibility.
CONDUCT MEETINGS, PROCESSES, AND STUDENT RIGHTS
Administrative Action
An Administrative Action meeting may be the response to a reported incident of misconduct, where the outcome does not include the possibility of contract termination or housing ineligibility. Students reported as allegedly violating policy will be provided the opportunity to respond to allegations and present witnesses before a decision is finalized.
A student has the right to be assisted by an advisor, but the advisor is not permitted to speak or participate directly. In the event a student is determined to have violated a policy, sanctions issued by a University Residences administrator may involve a written warning, reprimand, letter to parents or guardian, relocation to another room or residence, restorative action, restitution, an educational sanction, or any combination thereof. Sanctioned decisions shall be in writing and are final.
Contract Review
A Contract Review meeting may be initiated when misconduct is reported as it relates to a section called “Termination for Violation of Contract or Rules, Regulations, and Policies” of the Student Housing Contract, where the outcome could include contract termination or housing ineligibility in addition to Administrative Action sanctions.
Prior to the meeting, the student will be informed of the reported incident, the alleged rule violation, and the name/department of the witness, if any. During the scheduled meeting, notes will be taken, but no one may use an electronic recorder. The student may present witnesses and evidence on their own behalf. A student has the right to be assisted by an advisor, but the advisor is not permitted to speak or participate directly.
The student shall be promptly advised in writing of the University Residences’ outcome and any sanction imposed. If the decision is to terminate the student’s housing contract and/or enforce a period of ineligibility from University Residences or from any part thereof, the student may submit an appeal of the decision through a provided weblink to the Director of Campus Living and Compliance or designee, within a deadline of no less than 72 hours (3 business days). The Director or designee’s decision regarding the appeal shall be final.
Summary Exclusion
A Summary Exclusion is an immediate action taken by the Assistant Vice Provost for Student Life over University Residences and Purdue Dining and Culinary or their designee that prohibits a resident from entering any University Residence (UR) residential halls and Purdue Dining & Culinary (PDC) locations. This includes all property owned and operated by UR and PDC. A summary exclusion can be issued to a resident when:
- physical facilities are used in an inconsistent purpose,
- disruption of university programs, services, or activities will or did occur,
- interference with the educational mission of the university exists,
- threats or behaviors that pose a risk to the safety and security of the university community, or
- violation of a specific facility policy.
Resolution of the summary exclusion is exercised through the provisions outlined in the resident’s student housing contract, a contract review hearing, or administrative action hearing. Contracts are viewable within a student's Housing Portal. In cases regarding a court order, students may stay in a summary exclusion status until changes occur through a court’s order.
Conduct Sanctions
DISCIPLINARY SACTIONS
Disciplinary sanctions are directives issued that reprimand a student for their behavior. Further behavior along the same lines is unacceptable and may result in further disciplinary action from University Residences of the Office of Student Rights and Responsibilities.
Residential Warning
- Intended to emphasize the expectation that students comply with all policies not only in this building, but all of University Residences.
- Subsequent violation of University Residences' policy could result in the termination of a student's housing contract and/or ineligibility for housing in the future.
- A student's stay in housing is contingent upon their compliance with all expectations moving forward. Any further violation of University Residence regulations could jeopardize their eligibility to remain, visit, and/or contract for university housing in the future. This sanction is appealable.
- After completion of their current housing contract, students are made ineligible to live with University Residences for a designated peroid of time. This may include the cancelation of upcoming reapplications to housing at no cost to the student. This sanction is appealable.
- Students are required to move out of university housing by a stated date and time, and are subject to all cancelation/buyout fees outlined in the housing contract. This sanction is appealable.
EDUCATIONAL SANCTIONS
Educational Sanctions are mandatory learning opportunities for students who violate the University’s regulations, which require them to participate in reasonable and relevant educational activities that foster their personal, ethical and social development. Educational sanctions may be proposed in combination with other disciplinary actions. Certain educational sactions have associated fees, which are covered by the student. Examples of educational sanctions include but are not limited:
- alcohol and drug educational assignments
- referrals for substance use assessment
- custom creative assignments
- follow-up meetings
- letter(s) of apology
- reflective writing assignments
